TERMS OF SERVICE

These Terms of Service apply to purchases made through PokéDaddy Rips, including purchases made through our online store and products purchased for opening during our live Rip & Ship streams.

By accessing our website, placing an order or purchasing a product for Rip & Ship, you agree to these Terms of Service together with our Refund Policy, Privacy Policy and Shipping Policy.

1. PRODUCTS & ORDERS

PokéDaddy Rips sells trading cards, sealed trading card products, collectables and related products.

We make reasonable efforts to ensure product descriptions, images, pricing and availability are accurate. Colours, packaging and product appearance may vary slightly from images displayed online.

We reserve the right to correct genuine pricing, description or inventory errors and to cancel and refund an order where we are unable to fulfil it.

All orders are subject to availability and acceptance.

2. LIVE RIP & SHIP

Certain products may be purchased using our Rip & Ship service.

By purchasing a product for Rip & Ship, you authorise PokéDaddy Rips to open the specific product purchased on your behalf during a live stream.

Once opening of your product has commenced, the order cannot be cancelled because you have changed your mind.

The contents pulled from the product purchased for you belong to you and will be packed and shipped in accordance with your selected shipping option.

You do not need to be present during the live stream for your Rip & Ship order to be fulfilled unless a particular product or promotion expressly states otherwise.

Livestreams may occasionally experience interruptions, delays or technical difficulties. Where this occurs, we will take reasonable steps to ensure purchased products are still correctly allocated, opened and/or fulfilled.

3. RANDOM TRADING CARD CONTENTS

Trading card booster packs, boxes and similar sealed products contain randomly assorted contents determined by the manufacturer.

Unless expressly stated in the relevant product listing, PokéDaddy Rips does not guarantee that a purchased product will contain any particular card, character, rarity, artwork, chase card or monetary value.

The market or resale value of trading cards may fluctuate and is not guaranteed by PokéDaddy Rips.

Being disappointed with the cards contained within an otherwise correctly supplied product does not constitute a product fault and does not, by itself, entitle a customer to a change-of-mind refund.

4. CANCELLATIONS & CHANGE OF MIND

Please choose carefully when placing an order.

Requests to cancel an order should be made as soon as possible. We may be able to cancel an order if processing or fulfilment has not commenced.

Rip & Ship orders cannot be cancelled for change of mind once the purchased product has begun to be opened.

We are not required to provide a refund or exchange simply because a customer changes their mind, subject always to any rights the customer has under Australian Consumer Law.

5. AUSTRALIAN CONSUMER LAW

Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

If a product is faulty, damaged, incorrectly supplied, does not match its description or otherwise fails to meet an applicable consumer guarantee, please contact us so the matter can be assessed and an appropriate remedy provided in accordance with Australian Consumer Law.

6. SHIPPING

Customers are responsible for providing accurate and complete delivery information when placing an order.

Orders will be shipped using the shipping method selected at checkout or otherwise agreed with the customer.

Estimated delivery times are estimates only and may be affected by circumstances outside our reasonable control.

Any arrangements allowing customers to combine or hold multiple orders for later shipment will be subject to the conditions stated in our Shipping Policy.

If you believe an order has been lost, damaged or incorrectly delivered, please contact us promptly so we can investigate the issue and, where appropriate, assist with the carrier and provide any remedy required by law.

7. PRICING & PAYMENT

All prices are displayed in Australian dollars (AUD) unless otherwise stated.

The total amount payable, including applicable shipping charges, will be displayed during checkout.

Payment must be successfully completed before an order is fulfilled.

PokéDaddy Rips may change prices for future purchases at any time. A later change in the price of a product does not alter the agreed price of an order that has already been accepted and paid for.

8. TRADING CARD CONDITION

We take reasonable care when handling and packing trading cards.

Freshly opened cards are not guaranteed to receive any particular professional grading result. Manufacturing and packaging processes may result in variations such as centring, print lines, surface marks, edge or corner imperfections.

Unless specifically advertised as professionally graded, no representation is made that a card will achieve any particular grade from PSA, CGC, BGS or another grading service.

This section does not limit any rights relating to products that fail to meet the consumer guarantees under Australian Consumer Law.

9. LIVE STREAM CONDUCT

We want our live streams and community to remain safe and enjoyable.

We may moderate or remove comments and restrict participation in our live streams where reasonably necessary in response to abusive, threatening, discriminatory, sexually inappropriate, fraudulent or seriously disruptive behaviour.

Removing someone from a live stream does not affect our obligation to fulfil any valid order they have already purchased or any rights they have under Australian Consumer Law.

10. INTELLECTUAL PROPERTY

Unless otherwise stated, original PokéDaddy Rips branding, website copy, graphics and other original content created for our business may not be reproduced or commercially used without permission.

Third-party product names, trademarks, characters and brands remain the property of their respective owners.

PokéDaddy Rips is an independent retailer and is not affiliated with, endorsed by or sponsored by The Pokémon Company, Nintendo, Game Freak or other third-party brand owners unless expressly stated otherwise.

11. FRAUD & MISUSE

We may refuse or cancel an order where we reasonably believe an order involves fraud, unauthorised payment activity, misuse of our services or a genuine pricing or inventory error.

Where an order is cancelled by us and payment has already been taken, we will provide any refund required in accordance with applicable law.

12. CHANGES TO THESE TERMS

We may update these Terms of Service from time to time to reflect changes to our business, services or legal obligations.

Changes will apply from the date the updated Terms are published and will not retrospectively remove rights that have already arisen in relation to an existing purchase.

13. GOVERNING LAW

These Terms are governed by the laws applicable in Victoria, Australia and the applicable laws of the Commonwealth of Australia.

Nothing in this section limits any rights a consumer may have under applicable consumer protection laws.
